A top lawyer knew he killed a cyclist in a road accident but fled the scene and hid from police for hours to avoid an alcohol test, a court has been told.

The lawyer, Eugene McGee, had shared three bottles of white wine with his brother in the hours preceding the fatal hit-run in 2003, prosecutor Emily Telfer told the South Australian District Court on Friday.

McGee and his brother later drove through a police roadblock near the accident scene without identifying himself as the driver of a car which hit and killed the cyclist in SA's Barossa Valley, Ms Telfer said.

Eugene McGee and his brother Craig McGee pleaded not guilty on Friday to conspiring to attempt to pervert the course of justice.

Ms Telfer said the lawyer had told his 2005 trial, when he was fined $3100 for driving without due care, "he knew someone had been killed and he knew he was in serious trouble".

Ms Telfer said McGee knew of a law stating blood alcohol tests had to be taken within two hours after an accident to be legally relevant.

"Eugene McGee, by reason of his profession and his work history, was aware of those provisions," she told the court.

Eugene McGee was never breath or blood-tested for alcohol following the crash, which killed cyclist Ian Humphreys.

His perceived light sentence for driving without due care prompted the SA government to rewrite laws and enact harsher penalties for the offence.

His case was also subject of a royal commission, which criticised police for their handling of the case and found their investigation was not undertaken appropriately, efficiently or expeditiously.

The royal commission recommended the brothers face the conspiracy charge and the McGees went to the High Court in an unsuccessful bid to have the count dropped.

On Friday, Ms Telfer said Eugene McGee "determined to stay away from areas where he might be detected by police" in the hours after the crash.

McGee waited until two hours after the crash before leaving his damaged car at his mother's house, near the accident scene, she said.

His brother then drove him to Adelaide, when they travelled "through a police roadblock where no effort was made to identify Eugene McGee", Ms Telfer said.

The trial, expected to last three more weeks, was continuing

groan Do these guys just re-cycle the same series of anti-bike articles on a two month rotation or something?

I picture these investigatory journalists sitting in a round table meeting, the head editor going "Johnson...we need a teen binge drinking piece....Smith, chase up some leads on over priced groceries.....White, get me an anti-cycling bit...there should be a couple in the filing cabinet out the back".

CM, why don't you try to solve the mystery of who put that mud in my freezer? Who wants chocolate ice cream....?

The answer is simple....dont buy the newspaper. Don't get all worked up over it and don't generate another huge thread similar to the one last week, all it does is add fuel to the fire.

Im keen to take a stab in the dark and suggest this is in direct retaliation to the smashing the paper got last week for quoting (I mean mis-quoting) Andrew.

Who would have thought that out of all the State, National and International news over the past 24hrs this could be viewed by the editor as a good cover story.....How are the people in Haiti coming along?

Maybe this is a better thread for the roadies....I dont see too many red lights at Gap Creek Reserve. Maybe we should get the pro tour (roadies) to stop at a red light or two and then by early next week they would all be doing it.

Rickb I think you are right on the money there. It's a great filler piece they create community anger which then spills over into road rage as people justify their behaviour because the CM says that cyclists are dangerous.. Thanks CM for making it more dangerous out there.

I'm fed up with cyclists blatantly breaking road rules as well. Just as I am with motorists, pedestrians etc... I had to laugh when they talk about cyclists congesting streets yet the photo doesn't have a car in sight.

Yep, funnily enough my comment, which was not offensive hasn't appeared. So much for genuine debate.

Seriously though, it's time there was a boycott (official or unofficial) of the courier mail by cyclists. They offer no solutions, are inflammatory and pander to populist views. I for one will not be buying the paper or using their site in the future (seriously).

Overall it is an embarrassing excuse for journalism. It is the written equivalent of TV's ACA, ie pick an angle on a story and selectively leave out any information that does not support it.

No more courier mail I say, until they lift their reporting standards (which would take years).

I must admit I have seen some idiot cyclists this week. I'm not at all suprised at the 'backlash'. Unfortunately powers such as the courier mail don't recognise the positive difference they could make. If they had a concerted attempt to encourage drivers onto bikes then I'm sure there would be a tangible improvement in city traffic, and at least that individuals mental and physical well-being - if not the greater city at large. I don't understand why they don't do this - perhaps it sells less papers.

Only three cyclists running that red light for the month of November is without question less than the number of cars that would have done the same.

I agree Eljay, I stopped reading this "Woman's Daily" years ago.

Good point Bangers. Imagine a city even slightly less dependent on cars; everyone wants it but only a few think it has anything to do with them.

Thought-provoking articles are difficult to write but that doesn't mean it is right to print dribble in it's place.

Oh well, off for a ride, might harass a few people in their 1 tonne cars on my 10kg bike.

Did anyone else notice there were no cars in that pic? I live about 400m from that intersection. That is a pretty bloody busy set of lights. It must of been around 4-5am on a public holiday for it to be that quiet. I think Australia day was about the last time I had seen the intersection like that! Although it doesn't excuse the light running, who would blame them for going through it? I must admit I would've.

Wonder what the result will be? Probably the same as if they'd asked a group of cyclists if they think cars are a hazard on the road.

Spotted a goup of FOUR cyclistscaught on film THREE times in November.

HOW MANY CARS WERE CAUGHT IN NOVEMBER ???

How do we get the word out for National DRIVE to work day on February 24th ? Will BQ back this program? I know it's not mine, Can't remember who brought it up ages ago. Make sure you shower at home and drive in to wok, leave home between 7.00 and 8 am. Even better, drive in to town really early, park and shower at work or c2c. Make sure you take up the available car parking spots. Put a copy of the CM front page on your back windw (while parked)., Photocopies accepted.

I think Matt is on the money with this being retalitory for the bad press they got over Andrews non story.
